GLOUCESTER, Va. (AP) — A transgender teen is asking a federal judge not to allow a Virginia school board to hold off on letting him use the boys bathroom when school starts this fall.

Last week, U.S. District Court Judge Robert G. Doumar ordered that the Gloucester County School Board must let Grimm use the bathroom that corresponds to his gender identity while the court examines the legal issues of his case.

But the board asked the judge this week to put that mandate on hold while it asks the Supreme Court to intervene. An appeals court said the board discriminated against Grimm by forbidding him from using the boys’ restroom.

On Friday, attorney’s for Grimm said he would “irrevocably lose his senior year” if Doumar’s order was delayed.
