DETROIT (AP) — A judge has ordered a 28-year-old man to stand trial on a first-degree murder charge in the killing of an 8-year-old boy who was shot while sleeping inside his home in a Detroit public housing project.

Authorities say a bullet penetrated a wall at the Brewster Homes on July 30, killing Jakari Pearson. He was about to start fourth grade.

Detroit District Judge Kenneth King ruled Thursday there’s enough evidence to try Calvin Mosby for murder. The judge dismissed a first-degree murder charge against 17-year-old Devaunte Starks, ordering him tried instead on concealed weapons, home invasion and accessory charges.

Jakari’s mother says she formerly dated Mosby. Samona Cochran testified that she confronted him July 29 about a break-in at her house, and Mosby left her several angry voice messages.
